Flexible Click provides digital, software, automation, artificial intelligence, marketing, and business technology solutions.

Services may include, but are not limited to:

• Conversation AI
• AI-powered automation

• Customer relationship management solutions
• Reputation management
• Review management

• Lead generation and follow-up systems
• Appointment and scheduling automation
• Messaging automation
• Business workflow automation
• Marketing technology
• Reporting and analytics
• Software-as-a-Service (“SaaS”) products
• Consulting, implementation, and support

Features and availability may change as our products and technology evolve.

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or use Flexible Click services.

If you use Flexible Click on behalf of a company or other organization, you represent that you have authority to accept these Terms on that organization's behalf.

Certain services may require an account.

You are responsible for:

• Providing accurate account information
• Maintaining the confidentiality of login credentials
• Restricting unauthorized access to your account
• Activities occurring through your account

Notify Flexible Click promptly if you believe your account has been accessed without authorization.

Certain Flexible Click services may be offered through monthly, annual, usage-based, or other recurring subscription plans.

By purchasing a recurring service, you authorize Flexible Click and its payment providers to charge your selected payment method according to your chosen plan.

Subscriptions may automatically renew until canceled unless otherwise stated during checkout or in your service agreement.

Prices may change. When required, Flexible Click will provide notice before a pricing change affects an existing recurring subscription.

Applicable taxes may be added to your charges.

Depending on your plan and usage, your Flexible Click service may include several types of charges. Your costs may include:

• One-Time Setup Fee — A one-time fee for the initial setup, configuration, customization, and launch of your Flexible Click system.
• Monthly Subscription — Your recurring monthly subscription is based on the Flexible Click plan you select.
• Domain Renewal — Your domain is billed annually and is separate from your monthly subscription.
• AI & Communication Usage — Additional usage-based fees may apply for services such as AI Voice, Conversation AI, SMS/text messages, emails, and phone calls. Usage charges can vary depending on how much these services are used.

The one-time setup fee, monthly subscription, annual domain renewal, and usage-based charges are separate charges.

Customers may cancel recurring services according to the cancellation terms associated with their specific plan or agreement.

Unless otherwise required by law or expressly stated in writing, cancellation prevents future renewals but does not automatically provide a refund for previously billed periods.

Certain implementation, setup, custom development, onboarding, domain, advertising, usage, or third-party expenses may be non-refundable.

Except where required by applicable law or expressly stated in a written agreement, payments made to Flexible Click are non-refundable once the applicable service, subscription period, setup, implementation, or custom work has begun.

Any specific refund guarantee displayed at the time of purchase will control over this general provision for that purchase.

Certain Flexible Click products use artificial intelligence and automated systems.

These systems may generate or assist with:

• Voice conversations
• Written responses
• Customer support
• Lead qualification
• Appointment scheduling
• Marketing content
• Social media content
• Follow-up messages
• Recommendations
• Automated workflows

Artificial intelligence is probabilistic and may occasionally produce inaccurate, incomplete, inappropriate, outdated, or unexpected outputs.

Flexible Click does not guarantee that AI-generated information will always be accurate or error-free.

Customers are responsible for reviewing AI systems and outputs where appropriate for their business and configuring appropriate human oversight.

AI services should not be relied upon as a substitute for qualified legal, medical, financial, accounting, emergency, or other licensed professional advice.

Flexible Click may provide technology capable of making or receiving calls, sending or receiving messages, and conducting automated customer communications.

Customers using these services are responsible for ensuring their use complies with applicable laws, regulations, industry rules, consent requirements, opt-out requirements, calling restrictions, recording laws, and marketing communication requirements.

This may include laws governing automated telephone calls, artificial or prerecorded voices, SMS/text messaging, telemarketing, call recording, and consumer consent.

Customers must obtain all legally required permissions and consents before using Flexible Click technology to contact individuals.

Flexible Click technology must not be used to send unlawful spam, conduct deceptive communications, impersonate others, or contact individuals without legally required authorization.

Customers retain ownership of the business and customer data they lawfully submit to Flexible Click.

You represent that you have the legal right and necessary permissions to provide such data to Flexible Click and to instruct Flexible Click and its service providers to process it for the services you request.

Flexible Click may process customer data as necessary to:

• Provide services
• Maintain accounts
• Operate automations
• Deliver communications
• Provide support
• Detect fraud or abuse
• Improve security
• Maintain and improve services
• Meet legal obligations

Flexible Click services may integrate with or rely upon third-party platforms and providers.

These may include:

• CRM providers
• Payment processors
• Email providers
• SMS and telephone providers

Third-party products are governed by their own terms and privacy practices.

Flexible Click does not control third-party platforms and cannot guarantee their uninterrupted availability.

Changes, outages, restrictions, API modifications, account suspensions, or discontinued services by third parties may affect Flexible Click functionality.

Customers are responsible for the legality and accuracy of information, instructions, content, customer lists, and data they provide.

Customers must use Flexible Click services in compliance with applicable laws.

You may not use Flexible Click to:

• Commit fraud
• Mislead or impersonate another person
• Violate intellectual property rights
• Distribute malware
• Conduct unlawful surveillance
• Send unlawful spam
• Harass or threaten others
• Conduct illegal telemarketing
• Collect information unlawfully
• Circumvent security systems
• Attempt unauthorized access to systems
• Engage in unlawful or deceptive activities

Flexible Click may suspend or terminate access when it reasonably believes services are being misused.

For website design or development projects, ownership and licensing rights may depend upon the applicable service agreement or package.

Customers are responsible for content they provide, including logos, photographs, trademarks, text, videos, and other intellectual property.

Customers represent that they have permission to use materials supplied to Flexible Click.

Third-party software, templates, plugins, fonts, stock media, APIs, and integrations remain subject to their respective licenses.

Flexible Click retains ownership of its proprietary technology, systems, software, processes, methodologies, designs, templates, branding, documentation, automation frameworks, and other intellectual property unless otherwise agreed in writing.

Purchasing a Flexible Click service does not transfer ownership of Flexible Click's underlying software, technology, or proprietary systems.

If you voluntarily provide suggestions, ideas, or feedback regarding Flexible Click services, Flexible Click may use that feedback to improve its products and services without an obligation to compensate you.

Flexible Click works to maintain reliable services but does not guarantee uninterrupted or error-free operation.

Services may occasionally be unavailable because of:

• Maintenance
• Software updates
• Internet outages
• Third-party provider outages
• Security incidents
• Technical failures
• Events beyond our reasonable control

Flexible Click provides technology and services intended to help businesses improve operations, communication, marketing, and customer engagement.

Flexible Click does not guarantee specific:

• Revenue
• Leads
• Sales
• Search rankings
• Reviews
• Followers
• Engagement
• Appointment volume
• Conversion rates
• Business growth

Results depend on numerous factors outside Flexible Click's control.

To the maximum extent permitted by applicable law, Flexible Click services are provided on an “as is” and “as available” basis. Flexible Click disclaims warranties not expressly provided in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Flexible Click will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business opportunities, goodwill, or data arising from use of the services.

To the maximum extent permitted by applicable law, Flexible Click's aggregate liability arising from a service will not exceed the amount the customer paid Flexible Click for the affected service during the three months immediately preceding the event giving rise to the claim, unless a different limitation is required by law or agreed in writing.

To the extent permitted by law, you agree to indemnify and hold harmless Flexible Click and its owners, employees, contractors, and affiliates from third-party claims arising from your unlawful use of the services, content or data you provide, violation of these Terms, or violation of another person's rights.

Flexible Click may suspend or terminate services when reasonably necessary because of:

• Nonpayment
• Fraud
• Security threats
• Illegal activity
• Abuse of services
• Material violations of these Terms
• Actions that create significant risk to Flexible Click, its providers, or other users

Termination does not eliminate payment obligations incurred before termination.

Flexible Click may modify, improve, replace, or discontinue features as technology and business requirements evolve.

Flexible Click will make reasonable efforts to avoid materially disrupting paid services where practical.

Flexible Click may update these Terms periodically.

The updated version will be posted on the website with a revised “Last Updated” date.

Continued use of the services after an updated version becomes effective constitutes acceptance to the extent permitted by law.

These Terms are governed by the laws of the State of Pennsylvania, without regard to conflict-of-law principles. Any applicable venue or dispute-resolution requirements may be further specified in an individual service agreement.
